Jared Enns is a partner in the Litigation (Aboriginal Law) and Restructuring & Insolvency Groups at Cassels, providing clients with advice on Aboriginal title and rights related litigation as well as complex insolvency and restructuring matters. Jared has extensive litigation experience, having represented clients at the Supreme Court of Canada and having appeared before all levels of court in British Columbia and Manitoba, the Alberta Court of Appeal, and the Saskatchewan Court of King’s Bench.

In his litigation practice, Jared manages and leads a significant number of the Aboriginal Law group’s litigation mandates across Canada. In this capacity, Jared frequently represents and advises governments (including provincial, local, and municipal governments), industry stakeholders in various sectors, and private landowners in connection with, and in response to, Aboriginal rights and title litigation matters. Jared also advises clients on issues pertaining to the duty to consult, Indigenous self-governance, and constitutional law.

In his Restructuring & Insolvency practice, Jared assists and guides clients through proceedings under Companies’ Creditors Arrangement Act (CCAA) and the Bankruptcy and Insolvency Act, acting for court appointed officers, trustees, interim lenders, creditors, debtors, and directors. Jared has experience advising clients in a diverse range of industries and sectors, including cannabis, retail, construction, real estate, forestry, mining, and manufacturing.

Litigation — Aboriginal Law

  • Lead counsel to various government clients in connection with, and in response to, significant Aboriginal title claims
  • Strategic advisor to government clients in connection with their constitutional obligations and response to significant Aboriginal title and treaty rights claims
  • Strategic advisor to an intervener in proceedings before the Supreme Court of Canada
  • Lead counsel to municipal governments and corporations in connection with various development projects, including wastewater treatment facilities, energy infrastructure, and environmental matters
  • Co-counsel to Metro Vancouver Regional District in Giesbrecht v British Columbia, 2018 BCSC 822, in which the British Columbia Supreme Court accepted that private landowners can advance extinguishment as a defence to Aboriginal title claims
  • Advising Indigenous clients on various matters, including Aboriginal title, treaty rights, and consultation matters

Insolvency

  • Counsel to the interim lender in Canada North Group of Companies’ CCAA proceedings, including before the Supreme Court of Canada
  • Counsel to the court-appointed Monitor in the CCAA proceedings of Mountain Equipment Co-Op
  • Counsel to a licensed cannabis producer in its restructuring under the CCAA
  • Counsel to the court-appointed Monitor in the restructuring of the Ascent group of companies
  • Counsel for Pandion Mine Finance in the receivership of Otso Gold Corporation
  • Counsel to a crypto currency company in connection with its cross-border restructuring strategy
