Cassels successfully secured a significant costs award following a complex estates trial. Justice Callaghan awarded the Estate of Dr. William Robert Waters a total of $700,000 in costs against the primary defendant, Gillian Henry.
This outcome follows the Estate’s success after a five-week trial. The litigation focused on the recovery of funds and assets transferred by the late Dr. Waters to Ms. Henry. The Court ultimately found in favour of the Estate, ordering the return of substantial assets.
Justice Callaghan confirmed that the Estate was the more successful party overall and emphasized that the litigation was necessary to recover assets that would not have otherwise been returned. The Court also recognized both the complexity of the issues involved and the significant recovery achieved.
