Seven Issues Impacting Construction in 2022 and How to Address Them in Your Contracts

In the last two years, owners and contractors have been sent scrambling to identify (if possible) and consider obscure provisions of their contracts. Pandemic shutdowns, isolation requirements, commodity price fluctuations, and other uncharacteristic events have left many owners and contractors out-of-pocket when they realize these issues are not, or are inadequately addressed, in their contracts. While we are hopeful for some stability in 2022 (Omicron suggests otherwise) there are several issues that we anticipate will impact the construction industry in 2022. During our program, we will identify our top seven issues that we anticipate will permeate construction projects during 2022 and discuss how these issues can be managed in your construction contracts.

The Construction Act: Revisiting the Fundamentals and What’s New in 2022
In response to the high demand for a course that ignores the intricate details that lawyers focus on and goes back to the basics of what clients really want to know, this seminar is intended to provide a refresher course on liens, trusts, prompt payment, adjudication, and other hot-button topics that often arise under the Construction Act. We will cover the basic remedies that clients will most often pursue under the Act and the various timelines associated with them. We will also highlight parties’ obligations under the Act and provide tips on best practices for managing your business in compliance with the Act.

The Impact of Aboriginal Law on Construction Projects and Planning Applications
This presentation will provide a brief overview of aboriginal law with an emphasis on how the duty to consult is engaged and applies to private sector construction projects. It will also review and consider how aboriginal law can impact a construction project, starting by looking at the planning approvals process through to the construction and investigate some strategies you can use to reduce the risk to projects.

The Effects of Insolvency on Construction Industry Participants: What Can Go Wrong and How to Protect Yourself
Parties to construction contracts, including owners, contractors, and trades, take great care to draft contracts to protect themselves in many potential circumstances. However, when insolvency of a party occurs, Canadian federal law steps in and the ability to enforce contractual and statutory remedies, including collection of invoices or termination, can be delayed or negated. In this seminar – led by two experts from our Restructuring & Insolvency Group – we will discuss the numerous ways in which innocent construction industry participants can be affected, including through stays of proceedings, super-priority financing, and the forced continued supply of materials or services. We will also look at several ways that parties can protect themselves or otherwise attempt to reduce risk.
