Dana Poscente is an associate in the Regulatory Group at Cassels. She advises provincially and federally regulated oil and gas and clean energy companies, pipeline companies, gas distributors, government entities, and Indigenous groups. Dana provides practical and strategic advice on obtaining necessary project approvals including regulatory and environmental permits. She has extensive experience with Federal Court judicial reviews and regulatory and litigation matters across western Canada. Dana has dedicated expertise on provincial and federal environmental assessments, as well as wildlife matters that affects proponents and government bodies including under under the federal Impact Assessment Act, Species at Risk Act, Fisheries Act, and Migratory Birds Convention Act, as well as applicable provincial laws. Dana regularly presents on timely regulatory topics and has been a guest lecturer with the University of Alberta Faculty of Law. She is on the executive committee of the Canadian Bar Association Natural Resources section for Alberta, South.
Prior to joining Cassels, Dana worked in environmental litigation and obtained a Masters in Science from the University of Oxford.
Dana’s recent representative work:
- Acted for large crude oil and natural gas producer on a sour gas regulatory dispute before the Alberta Energy Regulator, ultimately resulting in a successful settlement
- Acted for a rural natural gas co-operative by preparing and filing applications and responding to information requests on landowner engagement issues to obtain a pipeline license amendment under Alberta Energy Regulator Directive 056
- Advises a large inter-provincial pipeline on Canada Energy Regulator approvals for detailed pipeline route matters including Plan, Profile and Book of Reference corrections, deviations, and variances
- Represents Canadian Nuclear Laboratories, Canada’s premier nuclear science and technology organization, on ongoing Federal Court judicial review matters related to regulatory approval of the Near Surface Disposal Facility, on issues related to species at risk, Indigenous consultation, and environmental matters
- Acts for Prince Rupert Port Authority on regulatory and litigation matters including successfully settling a Federal Court judicial review of the federal lands environmental determination for the Ridley Island Export Logistics Platform (now CANXPORT)
- Advises Metro Vancouver on provincial environmental assessment matters in relation to its Northwest Langley Wastewater Treatment Plant
- Represented an Indigenous government in a Federal Court challenge of a permit issued under the Canadian Navigable Waters Act, resulting in successful settlement for our client
