Thomas Isaac has been quoted in an opinion article titled “Appeals Court Spared N.B. Aboriginal Title, Economic Disaster,” published by the Telegraph-Journal.
Writes Tom Mueller: “[T]he New Brunswick Court of Appeal overturned Justice Kathryn Gregory’s previous decision in Wolastoqey Nation v. New Brunswick, which opened the door to returning privately held lands to Indigenous groups. In December, the appeals court shut that door, finding that only Crown lands can be subject to declarations of Aboriginal title. British Columbia’s supreme court chose a different path earlier last year. That matters. Two provinces, facing similar title claims, are now moving in opposite legal directions.”
