Alessandra Fusco has been quoted in the article titled “Do Independent Contractors Have a Duty to Mitigate?” published by Canadian HR Reporter.
The article looks at a recent case from the Ontario Court of Appeal that provides some much-needed clarity on this topic, and serves as a reminder to employers around the use of contractors and termination agreements.
Says Alessandra: “It’s definitely a good decision to clear up some of the ambiguity around whether or not an independent contractor who’s subject to a fixed-term contract ordinarily has an obligation to mitigate their damages in the event of early termination — unless the contract provides otherwise.”
