Wendy Berman was quoted in the article “Top 10 Decisions with Cross-Border Impact” published in the 2017 edition of Lexpert’s Guide to the Leading US/Canada Cross-Border Litigation Lawyers in Canada.
Wendy provides commentary on the Alberta Securities Commission’s decision in R. v. Aitkens, which was appealed to the Supreme Court of Canada with R. v. Peers, only to be dismissed, reinforcing the fact that jury trials are all but unheard of for securities fraud in Canada.
She believes that “US counsel should pay attention because it means violations such as securities fraud, insider trading and illegal distributions ‘could impact officers’ of companies inter-listed on US and Canadian exchanges. ‘The bottom line is that individuals charged with securities law violations, including officers and directors of public companies … will be tried by judge alone.’”
