Sean Jackson (he/him/his) is a partner in the Intellectual Property Group at Cassels. Sean specializes in complex intellectual property litigation where he represents clients from a range of industries, including pharmaceuticals, medical products, cannabis, oil and gas, and telecommunications.

Sean has particular expertise in representing clients from the pharmaceutical industry in proceedings under the Patented Medicines Notice of Compliance Regulations (PM(NOC) Regulations). Sean has appeared before various levels of court, including the Federal Court and the Federal Court of Appeal and was part of a trial team that secured a damages award exceeding C120-million.

Whether asserting IP rights or defending against allegations of infringement, Sean takes pride in using his PhD in biochemistry to merge science and the law into creative solutions for his clients.

  • Acting for Janssen and Abbvie in a patent infringement action relating to Imbruvica (ibrutinib)
  • Acting for WhiteWater West Industries in a patent and industrial design infringement and impeachment action relating to water slides
  • Acting for Janssen, Actelion, and Nippon Shinyaku in a patent infringement action relating to Uptravi (selexipag)
  • Acting for Medexus Pharmaceuticals Inc. and medac Pharma GmbH in a patent infringement and impeachment action relating to injectable methotrexate solutions
  • Acting for Janssen and the Kennedy Trust in a patent impeachment and infringement action relating to Remicade (infliximab), a biologic treatment for rheumatoid arthritis
  • Acting for Janssen in an application for judicial review of a decision relating to esketamine
  • Acting for W.L. Gore & Associates in a patent infringement action involving vascular grafts and stent grafts
  • Acting for Coil Solutions Inc. in a patent infringement action involving coiled tubing injectors
  • Acting for Aziwell AS in a patent infringement action involving directional drilling technology
  • Acting for a plaintiff in patent infringement actions involving SAGD well pad technology
  • Acting for a defendant in a patent infringement action involving non-destructive testing of overhead transmission lines
  • Acting for a plaintiff in several actions for damages under section 8 of the PM(NOC) Regulations
  • Acting for Polar Stroller in a patent infringement action involving skis adapted for use on strollers
