Cassels Brock was retained by the Township of Coleman as appellate counsel to respond to an appeal by the Town of Cobalt. The Town took the position it had the right to operate a gravel pit within the Township as a legal, or legally non-conforming use. The Town also complained about costs of $85,000 awarded for the application. We were entirely successful demonstrating to the court that the Town’s position could not be supported in fact or in law.
