Shayna Clarke (she/her/hers) is an associate in the Litigation Group at Cassels. Shayna maintains a broad commercial litigation practice, offering experience in a variety of matters, including corporate/commercial disputes, contract disputes and class actions. Shayna has appeared before the British Columbia Supreme Court and the British Columbia Provincial Court. Shayna contributed to “The Collapsing Deal” presentation at the Hot Topics in Commercial Real Estate program, presented by the Pacific Business & Law Institute (PBLI),.which took place on February 7, 2023.
Shayna’s representative work includes:
- Bush v. Fennell, 2023 BCSC 2115: Counsel for the plaintiff in obtaining and upholding a freezing order in British Columbia over the defendants’ assets in aid of ongoing proceedings in New York state
- 1264777 B.C. Ltd. v Gill, 2023 BCSC 131, aff’d 2023 BCCA 410: Counsel for a private lender, including on appeal, in the successful enforcement of a $1.2 million mortgage and defence of the transaction against allegations of fraud, relying on the indoor management rule
Shayna graduated with a Juris Doctor (Cum Laude) from the University of Ottawa. She was an active member of the student community as a Triage Coordinator with Pro Bono Ontario. Prior to law school, Shayna graduated with a Bachelor of Commerce with Distinction from the University of Victoria.
Before joining Cassels as an associate, Shayna was a summer and articled student with the firm.
